Accused hurls abuses, attempts assault; Judge Shivangi Mangla stands firm against threats and harassment

New Delhi, April 2025:

In a shocking turn of events, a Delhi courtroom witnessed an unprecedented act of indiscipline and aggression when a convict and his counsel hurled abuses and issued life threats to a woman judge following a conviction in a cheque bounce case. The incident has raised serious concerns about the safety of judicial officers and the decorum within courtrooms.

Conviction Triggers Chaos in the Courtroom

The incident took place after Judicial Magistrate (NI Act) Shivangi Mangla convicted the accused under Section 138 of the Negotiable Instruments Act, which deals with dishonor of cheques. The Court had directed the accused to furnish bail bonds under Section 437A of the Code of Criminal Procedure (CrPC) on the next date of hearing.

However, instead of complying, the accused launched into a tirade against the judge. He allegedly attempted to throw an object at her in a fit of rage and instructed his lawyer to do “whatever it takes” to get a favorable verdict.

Shocking Threats to the Judge

The situation turned even more disturbing when the accused issued a direct life threat to Judge Mangla. According to the court’s order dated April 2, the accused stated:

“Tu hai kya cheez… tu bahar mil, dekhte hai kaise zinda ghar jaati hai.”
(Translation: "Who even are you… just meet me outside and let’s see how you make it back home alive.")

This threat was duly recorded in the court’s official order and has sparked strong condemnation from the legal fraternity.

Mental and Physical Harassment Recorded

Judge Mangla documented in her order that both the accused and his lawyer, Advocate Atul Kumar, harassed her mentally and physically. They reportedly pressured her to resign from her post and threatened to file complaints if she did not acquit the accused. The threats continued beyond the courtroom, with repeated efforts to intimidate her.

Judge Mangla Vows Legal Action

Despite the hostility, Judge Mangla asserted her commitment to justice and took a firm stand. She stated in her order:

"Still the undersigned stands against all the odds and always does the needful in favor of justice. The undersigned shall be taking appropriate measures against the accused before the National Commission for Women, Delhi for such threatening and harassment."

The Court has directed that necessary legal action be initiated before the National Commission for Women (NCW) against the accused.

Show Cause Notice to Advocate Atul Kumar

In a significant development, the Court also issued a show cause notice to Advocate Atul Kumar for his misconduct. He has been asked to explain in writing why criminal contempt proceedings should not be initiated against him for his behavior.

"Court notice be issued to counsel for accused Sh. Atul Kumar to show cause in writing providing relevant explanation for the conduct shown by him today and further to explain as to why he shall not be referred to the Hon’ble High Court for initiating criminal contempt proceedings against him for such misbehavior," the Court stated.

The advocate has been directed to file his reply on the next date of hearing.

Call for Institutional Support and Security for Judicial Officers

This deeply concerning incident underscores the urgent need for ensuring the security of judicial officers, particularly women judges, and maintaining the dignity of the court. Legal experts and bar associations are calling for strict disciplinary and criminal action against those who threaten and obstruct the functioning of the judiciary.
